SWEEPSTAKES SHALL BE CONSTRUED AND EVALUATED ACCORDING TO UNITED STATES LAW. DO NOT ENTER THIS SWEEPSTAKES IF YOU ARE NOT A LEGAL U.S. RESIDENT. 1. HOW TO ENTER: No purchase, and no entry fee, payment or proof-of-purchase necessary to participate in Sweepstakes. Sweepstakes starts January 10, 2009 at 12:01 a.m. CST and ends March 6, 2009 at 11:59 p.m. CST (the “Sweepstakes Period”).
BY ENTERING THIS SWEEPSTAKES, EXCEPT WHERE PROHIBITED BY LAW, ENTRANTS ACKNOWLEDGE THAT IF SELECTED AS A POTENTIAL WINNER, THEY WILL BE REQUIRED TO SIGN AND RETURN A RELEASE GRANTING KIMBERLY-CLARK GLOBAL SALES, LLC (“SPONSOR”), AMERICAN BROADCASTING COMPANIES, INC. AND BARWALL PRODUCTIONS, INC., THE RIGHT TO ANNOUNCE THEIR NAME ON THE TELEVISION PROGRAM “THE VIEW” AND/OR ON THE WEB SITE WWW.ROOMADAYGIVEAWAY.COM AND/OR OTHER PROMOTIONAL MATERIALS. THE RELEASE MUST BE SIGNED, RETURNED AND RECEIVED BY SPONSOR WITHIN FIVE (5) DAYS OF POTENTIAL WINNER’S RECEIPT OF SUCH DOCUMENT OR PRIZE WILL BE FORFEITED BY ENTRANT.
THERE ARE TWO WAYS TO ENTER:
(A) TO ENTER ONLINE: Log on to www.roomadaygiveaway.com (“Web Site”) during the Sweepstakes Period. The first time you visit the Web Site to submit an entry into the Sweepstakes, you will be required to complete an online registration form and asked to select a user name and password. For subsequent entry into the Sweepstakes, you will only be required to provide your user name and password to receive an entry. Online entries must be received and recorded no later than 11:59:59 PM CST on March 6, 2009 to be eligible to win.
The name of the person submitting an e-mail address upon registration must be the name of the authorized account holder of such e-mail address, otherwise entry may be deemed void. In the event of dispute over the identity of a potential winner, online entries will be declared made by the authorized account holder of the e-mail address on record for the entrant, and a potential winner may be required to provide identification sufficient to show that he/she is the authorized account holder of the e-mail address tied to the potentially winning entry. It is solely the responsibility of the entrant to notify Sponsor if the entrant changes his or her e-mail address during the Sweepstakes Period. To do so, log onto the Web Site, click on “Log in”, then click on “Update Profile” and update your profile as required. Proof of e-mailing does not constitute proof of delivery or entry. All entries become the property of Sponsor and will not be returned to entrant. Every online entry submission must be manually keystroked and manually entered by the individual entrant; automated and/or repetitive electronic submission of entries (including but not limited to entries made using any script, macro, bot or sweepstakes service) will be disqualified and transmissions from these or related e-mail or IP addresses may be blocked.
(B) TO ENTER BY MAIL: Hand print your name, address, daytime and evening telephone numbers and date of birth on an Official Entry Form or a 3” x 5” card. Mail your entry in a first class stamped envelope postmarked by March 6, 2009 to: Kimberly-Clark “Room-A-Day Giveaway III” Sweepstakes, P.O. Box 8514, Prospect Heights, IL 60070. Mass entries and partially completed and/or mechanically reproduced entries or rubber-stamped entries will be void and ineligible. Sponsor is not responsible for illegible, late, lost, mutilated, misdirected, postage due or stolen entries.
Limit one (1) entry per person and/or e-mail address, per day, regardless of the method of entry.
2. PRIZES: Sixteen (16) Grand Prizes will be awarded, each consisting of a check in the amount of Twenty Five Thousand dollars ($25,000) which may be used towards a room makeover. Actual retail value: $25,000. Total retail value of all prizes: $400,000. Sponsor reserves the right to substitute a prize of equal or greater value if the Grand Prize cannot be awarded as described for any reason. Limit one (1) prize per name and/or e-mail address and/or household. Neither Sponsor nor American Broadcasting Companies, Inc. nor Barwall Productions, Inc. assume any responsibility for any architectural design, construction or other related services required to accomplish a room makeover and will not be a party to any contracts relating to such services.
3. WINNER SELECTION, NOTIFICATION AND ANNOUNCEMENT: Winners will be selected in a series of random drawings according to the Drawing Dates set forth below. Two (2) winners will be selected in each of the first five (5) drawings, and one (1) winner will be selected in each of the next six (6) drawings, from among all eligible entries received (regardless of the method of entry) as of the date of that drawing; non-winning entries remaining after each drawing will be “rolled over” and will be eligible for inclusion in the next scheduled drawing. Drawings will be conducted by an independent judging agency whose decisions are final and binding. Odds of winning in any drawing are solely dependent upon the total number of eligible entries included in that drawing.
Each potential winner will be initially notified by phone at the phone number provided on their entry form on or about the date their entry was selected. If a potential winner is not available at the initial call, then over the next forty eight (48) hour period following the drawing, Sponsor's designee will make up to six (6) attempts to reach the potential winner via telephone at the phone numbers provided on the entry form. If the potential winner cannot be reached in person during such forty eight (48) hour period (no messages will be left on answering machines or voice mail systems) such potential winner will be disqualified and an alternate winner may be selected at random from among all of the remaining eligible entries as of that date. Sponsor is not responsible for technical difficulties with telecommunications systems beyond its control. As a condition of prize award, except where prohibited by law, potential prize winners will initially be required to sign and return a release granting Sponsor, American Broadcasting Companies, Inc. and Barwall Productions, Inc. the right to announce the potential prize winner’s name on “The View”, the Web Site and/or other promotional materials. The release must be signed, returned and received by Sponsor within five (5) days of potential winner’s receipt of such document. If the signed release document is not received by Sponsor within the required number of days, prize will be forfeited and an alternate winner selected. Subsequently, potential prize winners will also be required to sign and have notarized an Affidavit of Eligibility/ Liability Release, which must be signed and returned within fourteen (14) days of potential winner’s receipt of such documents. Failure to return an Affidavit of Eligibility/ Liability Release within the required number of days may result in prize forfeiture, and an alternate winner may be selected. Unless otherwise noted, allow ten (10) to twelve (12) weeks for delivery of prizes by mail following completion of notification process. Prizes will only be delivered to addresses within the United States.
With winners’ written permission (as applicable), the names of the first fifteen (15) winners will be announced on “The View” according to the schedule below (the name of the sixteenth (16th) winner will not be announced on “The View”.) Regardless of the announcement of any name, you are not a winner until you have signed and returned all required documents, been officially verified as a winner and otherwise have fully complied with the terms of these Official Rules. Sponsor, American Broadcasting Companies, Inc. and Barwall Productions, Inc. reserve the right due to scheduling, writing, editing or other production reasons or any other reason at their discretion to pre-record “The View” and winner’s name may not be announced on the air on the dates designated below and/or may not be announced on air at all. Sponsor, American Broadcasting Companies, Inc. and Barwall Productions, Inc. are not responsible for cancellation or preemption of show or for other circumstances that make it impractical or impossible to air or otherwise produce the Show as scheduled but will, as may be necessary, fulfill their responsibilities to fully execute this promotion in accordance with these rules. Except in TN and where otherwise prohibited by law, by entering this Sweepstakes, entrants grant Sponsor, American Broadcasting Companies, Inc. and Barwall Productions, Inc. the right to print, publish, broadcast and use worldwide in any media now known or hereinafter known the winner’s name, address, voice, statement, picture or other likeness, without additional compensation, for public relations, advertising and promotional purposes as may be determined by Sponsor, American Broadcasting Companies, Inc. and Barwall Productions, Inc.

4. ELIGIBILITY: YOU MUST BE A LEGAL U.S. RESIDENT RESIDING IN THE FIFTY (50) UNITED STATES AND DISTRICT OF COLUMBIA THROUGHOUT THE SWEEPSTAKES PERIOD WHO IS 18 YEARS OF AGE OR OLDER AS OF JANUARY 10, 2009 TO BE ELIGIBLE. Potential winners may be required to provide proof of legal U.S. residency if requested by Sponsor to determine eligibility and as a condition of prize award. Employees of Kimberly-Clark Global Sales, LLC, American Broadcasting Companies, Inc., Barwall Productions, Inc. its television properties and each of their respective parent, subsidiary, affiliate and successor companies, agents, representatives, divisions, suppliers, printers, distributors and advertising, promotional and judging agencies (collectively, “Sponsor and Promotion Parties”) and the immediate family and household members of each, are not eligible to participate or win.
5. GENERAL: The State of Wisconsin in the United States shall have jurisdiction over this Sweepstakes. Prizes will be awarded and/or delivered only to addresses within the United States. Unclaimed prizes will not be awarded. Except as determined by Sponsor in its sole discretion, no substitution of prize is offered, no transfer of prize to a third party is permitted, and non-cash prizes may not be redeemed for cash value (unless at the sole discretion of Sponsor). Prize winner(s) will be solely responsible for all applicable federal, state and local taxes on prizes. Winner will receive an IRS Form 1099 for the actual value of the prize. All other expenses on the receipt and use of the prize not specifically mentioned herein are solely the responsibility of the winner. Any portion of a prize not accepted by winner will be forfeited.
6. CONDUCT: By entering this Sweepstakes, entrants agree to be bound by these Official Rules and the decisions of the judges that shall be final and binding in all respects. The Official Rules will be posted on the Web Site throughout the Sweepstakes Period. Failure to comply with these Official Rules may result in disqualification. Sponsor reserves the right at its sole discretion to disqualify any individual found to be tampering with the entry process or the operation of the Sweepstakes or the Web Site; or to be acting in any manner deemed by Sponsor to be in violation of the Official Rules; or to be acting in any manner deemed by Sponsor to be unsportsmanlike or disruptive, or with intent to annoy, abuse, threaten or harass any other person. CAUTION: ANY ATTEMPT BY A USER OR ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
7. LIMITATIONS OF LIABILITY: Sponsor assumes no responsibility or liability for (a) any incorrect or inaccurate entry information, or for any faulty or failed electronic data transmissions; (b) any unauthorized access to, or theft, destruction or alteration of entries at any point in the operation of this Sweepstakes; (c) any technical malfunction, failure, error, omission, interruption, deletion, defect, delay in operation or communications line failure, regardless of cause, with regard to any equipment, systems, networks, lines, satellites, servers, computers or providers utilized in any aspect of the operation of the Sweepstakes; (d) inaccessibility or unavailability of the Internet or the Web Site or any combination thereof; (e) any injury or damage to participants or to any other person’s computer which may be related to or resulting from any attempt to participate in the Sweepstakes or download of any materials in the Sweepstakes. If, for any reason, the Sweepstakes is not capable of running as planned for reasons which may include without limitation, infection by computer virus, tampering, unauthorized intervention, fraud, technical failures, or any other causes which may corrupt or affect the administration, security, fairness, integrity or proper conduct of this Sweepstakes, then Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Sweepstakes in whole or in part.
8. WINNER RELEASES: All entrants, as a condition of entry into the Sweepstakes, agree to release Sponsor and Promotion Parties from and against any and all liability, claims or actions of any kind whatsoever for injuries, damages, or losses to persons or property which may be sustained in connection with accessing the Web Site, submitting an entry or otherwise participating in any aspect of the Sweepstakes, the receipt, ownership, use or misuse of any prize awarded, or while preparing for, participating in or traveling to or from any prize-related activity or any typographical or other error in these Official Rules or the announcement of offering of any prize. The winner shall bear all risk of loss or damage to their prize after it has been delivered. Sponsor makes no representations or warranties of any kind concerning the appearance, safety or performance of any prize.
